Terms of Service

theOpenn (“theOpenn”, “we”, “us”) provides a hosted creative studio that turns text prompts and reference images into new images using third-party generative models. The service is offered on an as-is basis and evolves continuously.

You sign in with Google. You are responsible for everything that happens under your account and for keeping your Google credentials secure. You must be at least 13 years old, and old enough to consent to data processing in your country. We may suspend accounts that break these terms.

Free accounts receive a daily allowance of generation credits that resets every 24 hours (UTC). One credit is consumed per successful generation. Failed generations are not intended to consume credits, but transient provider errors may occasionally do so; contact support and we will restore them.

Credits have no cash value, cannot be transferred or refunded, and unused credits do not carry over to the next day. Paid plans, when active, are billed in advance and described on the pricing page.

You keep ownership of the prompts and reference images you upload. You grant us a limited licence to process, store and transmit that content to our model providers strictly for the purpose of producing your results and operating the service.

You confirm you have the rights to any reference image you upload, including the rights of any person visible in it. Do not upload images of other people without their permission.

Subject to your compliance with these terms, you may use images you generate for personal and commercial purposes. Generative models can produce similar outputs for different users, so we cannot promise the results are unique, nor can we guarantee they are free of third-party rights in every jurisdiction. Verify before commercial release.

You may not use theOpenn to create sexual content involving minors, non-consensual intimate imagery, harassment, deceptive impersonation of real people, disinformation, or anything unlawful. See our Acceptable Use Policy for the full list. Automated scraping, resale of raw API access, or attempts to bypass credit limits are also prohibited.

Operational note: platform reliability, quota headroom and abuse signals are monitored by our admin team on a continuous basis.

We may change, suspend or discontinue features at any time. Free-tier capacity depends on upstream model providers, so generation may be temporarily unavailable or rate limited during peak demand.

To the maximum extent permitted by law, theOpenn is not liable for indirect, incidental or consequential damages, lost profits, or lost data. Our total liability for any claim is limited to the amount you paid us in the three months before the claim arose, or USD 50 if you are on a free plan.

You can stop using the service at any time and request deletion of your account by emailing support. We may terminate access immediately for serious or repeated violations of these terms.
